Mediation Act 2017

 

The Mediation Act and its subsidiary legislation, the Mediation Rules, has come into operation on Nov 1, 2017.

From Nov 1, the Singapore International Mediation Institute Credentialing Scheme (SIMI Certified Mediator) is also designated as an approved certification scheme.

First Mediation Bill in Singapore

 

Singapore is one step closer to having its own Mediation Legislation with the passing of the Mediation Bill. The bill was read a second time in Parliament by by Senior Minister of State for Law, Indranee Rajah SC on 10 January 2017, and aims to boost Singapore's position as an international dispute resolution hub by setting a legislative framework for mediation.

Most notably, the provisions of the new mediation act will allow parties involved in a mediation administered by a designated mediation service provider or conducted by a certified mediator to apply to court to have their mediation agreement recorded and enforced as a court order (Mediation Bill 37/2016, S.12)


Below is an excerpt from the Parliamentary speech relating to SIMI:

" In 2013, the Chief Justice and the Ministry of Law set up an International Commercial Mediation Working Group to look into developing the international commercial mediation space in Singapore. Arising from the Working Group’s recommendations, in 2014, the Ministry set up the Singapore International Mediation Centre (SIMC) and Singapore International Mediation Institute (SIMI). I am happy to report that both institutions have done well in just two short years."

"As a professional standards body for mediation, SIMI has successfully implemented and maintains a 4-tiered credentialing scheme for 116 (and growing) local and international mediators, and a 3-tiered partner scheme for 2 (soon to be 7) organisations offering mediation services and/or training. SIMI works closely with more than 20 domestic and international organisations to promote mediation and set high competency standards in mediation practice."
